Product Description and Conditions of Use
1. Product Description
WAY Watersport fins for twintip kiteboards are designed to provide kiteboarders with increased control, grip, and jumping performance. The fins feature a distinctive hollow profile intended to improve upwind riding and enable smoother landings. They are designed for experienced riders and must only be used by athletes with the appropriate level of experience as well as sufficient physical and mental fitness.
In addition to the fins, WAY Watersport offers the RISE Pad (Riser‑Pad), a wedge‑shaped mounting component designed to be installed underneath the bindings of a twintip kiteboard. The RISE Pad is used to influence and improve riding characteristics by adjusting the stance angle and board response.
The RISE Pad is height‑adjustable and can be configured in two different height settings depending on wind strength, riding style, and individual setup preferences. It is made of polypropylene and does not contain metal components.
The RISE Pad is intended exclusively for recreational water sports use and must only be installed and used as intended and in combination with compatible equipment.
2. Warnings and Assumption of Risk
Dangers of Kiteboarding
Kiteboarding is inherently dangerous. Users must obtain professional instruction and act with extreme caution at all times. WAY Watersport products may only be used when the user is in good physical and mental condition. Always select an appropriate kite size according to your skill level and the prevailing wind conditions, as sudden gusts can be life‑threatening. Never kiteboard in offshore or onshore winds or in the lee of obstacles. Turbo fins are not suitable for shallow water, reefs, or areas with seaweed.
Assumption of Risk
The use of WAY Watersport products involves the risk of serious injury or death to the user and to third parties. By using these products, the user acknowledges and accepts all known and unknown risks associated with kiteboarding and the use of performance‑oriented equipment. Observing warnings and using the products carefully may reduce risks but cannot eliminate them entirely.
3. Safety Guidelines for Use
Wind and Water Conditions
Avoid kiteboarding in unsuitable or unstable wind conditions and ensure that the riding area is free from obstacles such as seaweed, reefs, or floating debris. Turbo fins are designed for deep, clear water only.
Physical Precautions
Never allow body parts to come into contact with fins or mounting components in order to avoid injury. Users are strongly advised to begin use in lighter wind conditions to become familiar with the altered riding characteristics of WAY Watersport products and components. When installing, adjusting, or removing the RISE Pad, particular care must be taken, as improper or careless handling may result in fingers or skin being pinched between the pad, binding, or board components. Adjustments to the RISE Pad should only be performed when the board is not under load and when the user has full control of all components.
4. Liability Disclaimer and Waiver of Claims
Duty to Read and Inform
By purchasing and using WAY Watersport products, the user confirms that all instructions, warnings, and safety information have been read and understood. The user further agrees to inform any other person who uses the product of all associated risks and instructions.
Liability Disclaimer
To the maximum extent permitted by applicable law, the user waives any future claims against WAY Watersport and its contractual partners for damages or injuries arising from the use of the product. This waiver applies, where legally permissible, to heirs and legal successors. Nothing in this section limits liability where such limitation is prohibited by mandatory law.
5. Warranty Conditions
Scope of Warranty
WAY Watersport grants first‑time purchasers a limited warranty against material and manufacturing defects for a period of six months from the date of purchase. The warranty covers only defects resulting exclusively from material or manufacturing faults and includes repair or replacement at WAY Watersport’s discretion.
Warranty Terms
The warranty is non‑transferable and does not apply to rental or training equipment. It is valid only if the product has been used exclusively in water as intended. Warranty claims require registration on the WAY Watersport website and proof of purchase.
Exclusions and Misuse
The warranty does not cover damage caused by misuse, improper handling, normal wear and tear, excessive exposure to sunlight, heat, or improper mounting or installation. Any modification or alteration of the product without prior approval from WAY Watersport voids the warranty and liability.
6. Special Notes on Shape and Potential Damage to Other Equipment
Distinctive Shape and Required Care
WAY Watersport fins have a tapered, performance‑oriented shape. Due to this shape, special care must be taken to avoid damage to other equipment such as kites, lines, boards, or accessories. During storage, transport, and setup, users must ensure that the fins do not come into contact with sensitive materials.
Disclaimer for Consequential Damage
WAY Watersport assumes no liability for damage to other equipment resulting from contact with fins or mounting components. Careful handling is the responsibility of the user.
7. Storage, Maintenance, and Disclaimer for Modifications
Proper Storage and Transport
Products must be stored, transported, and handled with care at all times. Avoid placing objects on top of fins or pads and protect them from direct sunlight and excessive heat, as this may weaken the material.
Installation and Regular Inspection
Before installation or adjustment, ensure that fins, pads, and all related components are correctly aligned and free from sand, debris, or tension to guarantee secure mounting. Products must be inspected regularly for damage or wear, and damaged products must not be used. Improper alignment or forceful handling may lead to damage or injury.
Disclaimer for Modifications
Any independently performed modifications or repairs void all warranty and liability claims. WAY Watersport is not responsible for damages or accidents resulting from unauthorized product modifications.
